Terms and Conditions

1. Introduction#

Welcome to Realty.com.cy (the “Platform”), a technology-driven real estate marketplace operated by RimaTech Ltd, a company registered in Cyprus under company number HE 439114, with its registered office at Bridge Tower, Alexandrias 2–4, Limassol 3013, Cyprus (“RimaTech”, “we”, “us”).

These Terms and Conditions (“Terms”) govern your access to and use of the Platform. By using Realty.com.cy, you agree to be bound by these Terms, along with our Privacy Policy, Cookies Policy, and Complaints Policy, which are incorporated by reference.

1.1 Platform Role and Neutrality#

Realty.com.cy operates solely as a technology-driven marketplace. It does not provide licensed real estate agency services as defined under the Real Estate Agents Law 71(I)/2017, nor does it act as an intermediary, broker, or representative in any property transaction. All negotiations, agreements, and payments take place directly between users, who act entirely at their own risk and discretion.

2. Definitions#

  • Platform: The Realty.com.cy website and services provided by RimaTech Ltd.
  • User / you: Any person or entity accessing or using the Platform.
  • Listing User: A user who publishes or manages property listings on the Platform.
  • Cabinet: Registered user account providing extended functionality (saved searches, favourites, listings management).
  • Property Listing: Any real estate property information published on the Platform.
  • User-Generated Content: Any content submitted by users, including property descriptions, photos, reviews, or comments.
  • Third-Party Services: External services or links accessible through the Platform, but not operated by RimaTech.

3. Eligibility and Registration#

  • You must be at least 18 years old and legally capable of entering binding agreements.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your Cabinet login details.
  • RimaTech may suspend or terminate accounts where false, misleading, or unlawful information is provided.

4. Nature of Services and Lead Billing Model#

The Platform enables:

  • Browsing and searching property listings.
  • Contacting agents, developers, and other listing users.
  • Sending property enquiries and arranging viewings.

Lead Billing Model:

  • Visitors use the Platform free of charge.
  • When a visitor submits an enquiry (e.g., Arrange Viewing), their details are shared with the relevant listing user.
  • Listing users agree to pay Realty.com.cy for each valid lead they receive through the Platform.
  • Listing users are independent controllers of any personal data they receive from such enquiries.

Realty.com.cy is not a party to, and bears no responsibility for, any payments, deposits, or transactions between users. RimaTech Ltd provides only the technological means for communication and lead generation. Users are solely responsible for verifying the legitimacy of all payments and counterparties.

5. User Obligations#

You agree to:

  • Provide accurate information in listings and communications.
  • Use the Platform only for lawful purposes.
  • Refrain from uploading unlawful, defamatory, offensive, or infringing content.
  • Respect the rights and privacy of other users.
  • Not engage in spamming, phishing, scraping, or fraudulent behaviour.

In addition to the above, users must not:

(a) impersonate any person or entity or falsely state affiliation; (b) post fraudulent, misleading, or duplicate Listings; (c) attempt to manipulate search results or visibility rankings; (d) use automated tools, bots, or scripts to scrape or harvest data from the Platform; (e) reproduce, copy, or distribute any part of the Platform without prior written consent; (f) upload viruses, malicious code, or engage in any activity that interferes with system integrity or security; (g) circumvent or attempt to bypass payment, verification, or moderation systems.

6. Property Listings and User-Generated Content#

  • Listing Users remain responsible for the accuracy of property details.
  • By uploading content, you grant RimaTech a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your content in connection with the Platform.
  • RimaTech Ltd reserves the right, at its sole discretion, to review, edit, refuse, or remove any Listing or other content at any time without prior notice, if such content is inaccurate, misleading, unlawful, infringes intellectual property, violates these Terms, or may harm the reputation or functionality of the Platform.

7. Fees and Payments#

  • Certain features (e.g., premium listings, promotions, lead billing) may be subject to fees.
  • Fee structures are published on the Platform or agreed in commercial contracts.
  • Payments must be made through approved methods.
  • Unless otherwise stated, fees are non-refundable.

8. Intellectual Property#

  • All Platform content (design, logos, software, databases) is owned by or licensed to RimaTech.
  • Users may not copy, modify, distribute, or reverse-engineer the Platform without prior written consent.
  • User-Generated Content remains the property of the contributor, subject to the licence granted in Section 6.
  • Unauthorized copying, extraction, or reuse of Realty.com.cy content, databases, or Listings—whether by automated means (data-scraping, crawling, spidering) or manual copying—is strictly prohibited. The Platform’s database and structure are protected under EU Directive 96/9/EC and the Copyright Law 59/1976 as amended. RimaTech Ltd actively monitors for scraping and may pursue remedies against offenders.

Your use of the Platform is subject to our Privacy Policy.

  • Realty.com.cy processes personal data to operate the Platform, in line with GDPR.
  • Cookies and similar technologies are explained in our Cookies Policy.
  • Users have rights to access, rectify, erase, or restrict processing of their data.

10. Complaints#

We aim to resolve concerns quickly and fairly. Our Complaints Policy explains how to submit a complaint, how it will be investigated, and timelines for response.

Users should exercise caution when interacting with other parties. Do not send money or share financial information before personally viewing a property and confirming the legitimacy of the listing.

Realty.com.cy does not verify ownership, identity, or authenticity of Listings and bears no responsibility for losses arising from fraudulent activity or misrepresentation by users.

12. Indemnity#

You agree to indemnify and hold harmless RimaTech Ltd, its officers, employees, and affiliates from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your infringement of third-party rights.

13. Limitation of Liability#

  • Realty.com.cy is a technology platform. We do not verify property listings, and we are not responsible for the accuracy, completeness, or legality of user-generated content.
  • To the fullest extent permitted by law, RimaTech Ltd, its officers, employees, and affiliates disclaim all liability for:
    • reliance on listings or content published by users,
    • any transactions, negotiations, or communications between users,
    • interruptions, errors, or unavailability of the Platform.
  • Visitors (free users): RimaTech Ltd shall have no liability in connection with use of the Platform.
  • Listing users (paying clients): RimaTech’s aggregate liability shall not exceed the total fees actually paid by you to RimaTech for the month in which the event giving rise to liability occurred.
  • RimaTech Ltd shall not be liable for any failure or delay in performance, or for any unavailability of the Platform, caused by events beyond its reasonable control, including network outages, cyber-attacks, strikes, governmental actions, or natural disasters.
  • Nothing in these Terms excludes liability for fraud, gross negligence, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded under Cyprus law.

14. Suspension and Termination#

We may suspend or remove any account or content immediately, without prior notice or refund, if we reasonably believe it violates these Terms, legal requirements, or quality standards.

15. Governing Law and Disputes#

  • These Terms are governed by the laws of the Republic of Cyprus.
  • Disputes shall first be addressed under our Complaints Policy.
  • If unresolved, disputes will be referred to mediation or arbitration in Cyprus, or otherwise to the exclusive jurisdiction of the Cyprus courts.

16. Changes to Terms#

We may update these Terms from time to time. Updates will be posted on the Platform. Continued use of Realty.com.cy after updates constitutes acceptance of the revised Terms.

RimaTech may modify, suspend, or discontinue any part of the Platform or its features at any time without prior notice. Such modifications shall not entitle users to compensation or refunds.
